1.5 All services purchased through Worldcup Accommodation are made pursuant to agreements between enquirers and  owners and operators of accommodation establishments .Risk of loss passes from Worldcup Accommodation to establishment  owners and operators upon their receipt of confirmation of booking from our website , including but not limited to ghost enquiries,  fraudulent transactions, bad debts, cash or bank payments charges,or  by credit card fraud or charge backs or otherwise.
1.6 Neither Worldcup Accommodation nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use any service sold or offered  by this web site.
1.7 Worldcup Accommodation makes no representation regarding any other web sites that may be accessed through this service and accordingly accepts no responsibility for the content or use of such web sites or information contained therein. In addition, it shall not be liable to any party for any form of loss or damage, consequential or otherwise, incurred as a result of any use or reliance on any information contained on such a web site or any web sites which can be accessed through this web site.

2. PAYMENT OF BOOKINGS
2.1 Once an offer has been accepted, the establishment is solely responsible to make contact with the guest and to provide an invoice with their payment details to the guest. Once payment has been made against a quotation, the offer and its acceptance become a binding contract. Following acceptance the establishment is required to send confirmation of  receipt of payment to the guest, including clear directions to arrive at the establishment address.
2.2 The establishment is responsible , to enter via their  registration process, their own particular payment requirements, terms and conditions These payment options and requirements  must be displayed to the enquirer as part of the offer.

3. HOW PROCESS WORKS 
3.1 The user of the website makes an availability enquiry on our website.If your establishment is in the selected  City and offers the type of accommodation requested ,you will be notified of this enquiry via email.
YOU DO NOT HAVE  TO REPLY TO AN ENQUIRY. SIMPLY IGNORE OR DELETE THIS EMAIL! If the establishment has suitable and appropiate accommodation available during the required period and would like to reply ,a quotation is sent to the user.. This constitutes an offer by the establishment, which can be accepted or declined, or the enquirer can enter into  correspondence to ask you questions.Your offer is valid for 72 hours  from the  date and time that  you were notified.of this enquiry . Your offer constitutes a binding contract between the owner and the enquirer.You are required to provisionally reserve the rooms offered for the 72 hours period, unless you have been notified that your quote has been declined.
3.2 When  you receive confirmation of an offer , you will be provided with the guests contact details.You are required to contact the guest and arrange and  receive payment directly from the guest , as per your own terms and conditions ,
3.3 Establishments may apply cancellation policies and these must be  clearly displayed in your terms and conditions and in every quotation.

4. TERMS AND CONDITIONS FOR USING THIS WEBSITE

4.2 In the case of any amounts owing to Worldcup Accommodation by the establishment, which remain unpaid for a period of 30 days or more, the establishment agrees to pay a collection fee of 25%on the total outstanding amount plus any other costs that may be associated with the recovery of the debt,including summons and attorney fees.
4.3 Bookings through this website are subject to any Cancellation policy that may be stipulated by the establishment in their terms and conditions as advised to the guest 
4.4 Where a direct booking is made via a Worldcup Accommodation partner,or third party, guests should ensure they are familiar with the establishment and/or partner cancellation policy.
4.5 Worldcup Accommodation charges  a non-refundable booking commission of 10% excl VAT for standard listings and 20% excl VAT for featured listings of the total booking value for
facilitating the booking.
A once only administration fee of R 200/property plus vat is charged at same time as you receive your first confirmed booking.
This amount is due and payable within 7 days of establishment receiving an email  receipt of invoice for this referral commission due to  World cup Accommodation. This invoice will be sent to you at the same time as we inform you that you have a confirmed booking  for  your establishment .By using this service, the user acknowledges that Worldcup Accommodation is entitled to charge this commission in the event of a booking cancellation. In addition, in the event that an establishment retains a deposit payment in terms of its cancellation policy, then under no circumstances shall Worldcup Accommodation be held liable for repayment thereof. An offer made to a Guest by an Establishment is binding for the 3 day( 72 hours)  validity period from establishment receipt of the enquiry . Should the guest confirm an offer or make payment to the Establishment and the Establishment either refuses to honour or accept the booking or subsequently cancels the booking for any reason, the Establishment will be deemed to be in breach of contract . Establishment  will still  be liable for the payment of the standard commission for this disputed enquiry to Worldcup Accommodation. By loading their Establishment details onto this website , and replying to enquiries, the Establishment unconditionally expresses their full agreement to the above.
4.6 The receipt of the booking commission is important to funding the development and running costs of the website. Any attempt to pass email addresses, telephone numbers or other contact details or any other contact details by owners or guests to avoid paying commission is expressly prohibited. Any statement made by the establishment suggesting that the guest should go directly to the establishment’s own website is also strictly forbidden.
Transgressors will be first sent a warning. Any further infringements or a blatant attempt to by pass this condition will lead to establishments being  banned from website and there by be unable to reply to offers and receive confirmed bookings.
4.7 By responding to the guest either with a quote or a reply, the Establishment accepts that the introduction has been made by Worldcup Accommodation and undertakes to pay Worldcup Accommodation’s standard commission in the event that a booking is made by the guest either through Worldcup Accommodation or, directly with the establishment or, via any other 3rd party.
4.8 Worldcup Accommodation is not liable for incorrect rates specified on the web site and will not be obliged to supply bookings at those rates. The quotation, pricing and terms and conditions supplied by the establishment, is the sole responsibility of the establishment.

5. GOVERNING LAW
5.1 This site is managed, controlled and operated from the Republic of South Africa and is therefore governed by South African law.

6. PRIVACY
6.1 Worldcup Accommodation shall take all reasonable steps to protect the personal information of Users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 7. SECURITY
7.1 Worldcup Accommodation shall take all reasonable steps to protect the personal information of every user on the system and may store, not withstanding other information, the following; name and surname, birth date, e-mail address, telephone numbers, cellular numbers, physical addresses, other personal information including surfing habits, IP numbers, username and passwords for the system booking and client preferences and any other information the user submits to this website. Worldcup Accommodation only stores this information when a user has consented to these terms and conditions. Users are required, in every instance, to specifically indicate their consent before they are able to send an availability enquiry or a booking to an establishment. Personal information regarding establishments listed on the website is stored on the system when the owner registers. Owners are required, in every instance, to specifically indicate their consent to these terms and conditions before they are able to send a quotation in response to a guests booking enquiry.
7.2 Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Worldcup Accommodation suffers any damage or loss.

The Worldcup Accommodation website operates as an online  guide to enable users to find, book and pay Establishments  for their chosen preferred accommodation. Worldcup Accommodation thus acts as an advertising medium for the establishment and facilitates enquiries, offers, and confirmations between establishments and enquirers/guests .The contract is based on an offer by the establishment, which is accepted by the guest, and therefore exists legally between these two parties. Worldcup Accommodation’s responsibility with regard to this website and its use  is to assist both parties to engage  and confirm an accommodation booking. Establishment  arrange and  receive payment from the guest directly  for the full amount .

In the event of a dispute between the guest and the owner, Worldcup Accommodation will assist as much as possible, in resolving such dispute. Worldcup Accommodation does not, however, underwrite or guarantee bookings between guest and establishment or the accuracy of the information portrayed by the establishment or in its quote. In the event of any dispute between guest and establishment, Worldcup Accommodation will assist , to the best of its ability, with the resolving of such disputes but is not liable to either party for any claims, damages or refunds of any type.
